Continuance Policy

(1) The continuance policy shall be as set out in Rule 7A:14 except as noted below. (2) First requests for continuance of traffic matters may be made verbally and granted by the Clerk. Subsequent requests shall be submitted in writing and must state the grounds of the request. (3) Continuance requests for criminal matters shall be submitted in writing. Said written request shall state the grounds of the request and the position of the Commonwealth Attorney. (4) Continuance requests for civil matters shall be submitted in writing. Said written request shall state the grounds of the request and the position of opposing parties. (5) The Clerk is authorized to grant motions submitted stating all parties are in agreement. In the event parties are not in agreement; the request shall be submitted to the Judge for his approval or denial. (6) Parties and witnesses shall not be released until the Court rules on the motion for continuance. (7) No request shall be granted the day prior to court unless all parties are in agreement. (8) The Court has drafted a Motion for Continuance form. This form is not mandatory, but is recommended.
