Assignment of Error

1. The trial court erred in granting Appellee, Evelyn Rose Wilkinson, a right of way by necessity to a certain tract of real property owned by her in Washington County, Virginia, which right of way by necessity runs across and is located upon Appellants' real property because there was no unity of title between Appellee's real property and Appellants' real property at the time Appellee's real property became landlocked and there was no severance of unity of title between Appellants' real property and Appellee's real property when Appellee's real property became landlocked.
