Assignment of Error
- The Circuit Court erred when it denied Mr. Dominguez’s claim that his trial counsel provided ineffective assistance of counsel, in violation of Strickland v. Washington, 466 U.S. 668 (1984), and the Sixth Amendment, by failing to object to the trial court’s deficient jury instruction on malicious wounding that omitted the essential requirement of an intent to “permanently” maim, disfigure, or disable the victim.
