Assignments of Error
- The trial court erred when it quashed the garnishment as it applied to the account ending 61663. This action was in error because the evidence showed that the Garnishee had an obligation to utilize funds in the account ending 61663 to honor any withdrawals from the accounts titled to the judgment debtor.
- The trial court erred when it ordered payment of only those funds held in the accounts title to the judgment debtor when the Garnishee admitted that additional funds were available in the account ending 61663 to pay the debts of the judgment debtor and bank statements revealed funds in excess of $1,000,000.00 available to pay the debts of the judgment debtor.
- The trial court erred when it ordered that any funds in excess of $15,050.11 be returned as if the Garnishment had not been filed despite having received deposits from the Garnishee in the total amount of $148,706.80.
